The
ACRWSD was established on February 26, 1979 following the Corrected
Final Orders of the Stream Pollution Control Board dated July 5,
1979, Cause No B-422.
The statutory authority and duties of
the District shall be vested in the Board of Trustees as set forth
in I.C. 1971, 19-3-1.1-1 thru 19-3-1.1-28
The
ACRWSD is organized as an independent political entity of the State
of
Indiana
and as a body corporate and political.
The general purpose, for which the
District exists, is to provide for the collection and disposal of
sewage and distribution of water.
The governance of the District, and the
direction of its works and the control of its property and assets
shall be vested in the Board of Trustees consisting of seven (7)
voting members, each of whom shall be a registered voter in Allen
County, Indiana; in addition, four (4) non-voting, ex-officio
members, as hereinafter designated shall be appointed:
Three (3) voting members shall be
appointed by the Allen County Board of Commissioners, each for a
three (3) year term, with the initial appointments staggered so an
appointment will be annual thereafter; two (2) voting members shall
be appointed by the Mayor of the City of Fort Wayne, each for a four
(4) year term, with the initial appointment for a term of two (2)
years; one (1) voting member shall be a member or designee of the
Allen County Council, who shall be appointed for a two (2) year
term; one (1) voting member shall be a member or designee from the
Fort Wayne-Allen County Board of Health, who shall be appointed for
a two (2) year term.
The term of any voting member shall
expire on the last day of December in the year in which said term is
to expire.
The
District is not formed for pecuniary or financial gain and no part
of the assets, income, or profit of the district is distributable
to, or inures to the benefit of its trustees or officers.
